- that you are expressly contracting with us on these Terms and Conditions; and
- to be bound by these Terms and Conditions,
- these Terms and Conditions are current as at the date on which you first access or browse our site and/or complete the registration or shopping process;
- we may revise these Terms and Conditions and provide updated Terms and Conditions to you; and
- the revised Terms and Conditions are applicable upon accessing or browsing our site or ordering Products from us.
We are not bound to accept any order from you and reserve the right not to supply Products even if you have provided all information prompted by our website or customer service representative, including your credit card details. Your agreement with us for the sale of Products only comes into existence when we have confirmed your order and your payment has been processed or received.

Prices of Products and delivery charges displayed on our website are current at the time of display. These prices and charges are subject to variation without notice. All prices are inclusive of GST and unless otherwise indicated, are in Australian dollars.
While we take every care to be as accurate as possible with all information available on our website, including our Product descriptions and pricing, no warranty is given that such information is accurate, reliable, current or free from errors or omissions.
If a Product is mistakenly listed at an incorrect price, we reserve the right to refuse or cancel any order placed for Products listed at the incorrect price, whether or not the order has been confirmed and your payment processed.
If your payment has already been processed for the purchase and your order is cancelled, we will issue a credit to your credit card account in the amount of the incorrect price.
Your credit card payments will be secured by a 128 BIT SSL security certificate.
Payments accepted from visa and master cards only.
Delivery and Returns
It is your responsibility to ensure that your delivery instructions are accurate and to contact us if your order does not arrive.
Delivery charges vary depending on your country, state and the number of items brought as indicated on this site. We will, in all cases, be entitled to choose the method of transport of Products and may, at our discretion, subcontract delivery (at no additional charge to you). In general however, products will be delivered by Australia Post or by courier. Products are normally despatched on the fifth business day after the order has been received. If we delay sending your product by more than seven business days we will contact you to arrange an alternative delivery time or a full credit of any payment received.
If you have provided incorrect delivery instructions and Products are returned to us, you will be responsible for the cost of re-sending the Products.
Where a delivery date is specified, we will endeavour to deliver Products on the estimated delivery date. We may unilaterally delay or suspend any delivery for any period or deliver Products ordered by instalments.
You cannot reject delivery of any Products due to a delay in their delivery or if delivered in instalments.
If you have received the wrong Product or are unhappy with your purchase, please contact us at once by e-mail, fax or telephone. We will provide you with advice on how to return the Product for a full credit (including, where the wrong Product is dispatched, a refund of any delivery charges you incur).

- must be unopened and in their original packaging;
- will only be accepted within 14 days of receipt;
- must be securely packed so as not to incur any damage upon their return.
Out of Stock
If we are out of stock on any item ordered by you we will contact you within two business days to arrange either:
- a full credit of any payment received
- delivery of an alternative product of equal value
- a backorder of the original product requested (subject to that product still being in production)
Damaged Products
If Products delivered to you are found to be defective or damaged, please contact us at once by e-mail, fax or telephone. Once we receive the Product you claim was defective or damaged we will assess its condition.
If we find the Product is in full working condition (ie never been worn or used) or that any defects or damage were caused after you took receipt of and/or used the Product, it will be returned to you (at your expense) without further responsibility on our part.
If we find the Product is defective or damaged we will (at your option) either issue you with a credit of the original purchase price and delivery charges or dispatch a replacement Product.
Warranty
To the fullest extent permitted by law, and subject to any manufacturer’s warranties:
- all Products on this site are provided without warranties of any kind, whether express or implied;
- we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
We do not make any warrantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise.
Liability
Except as otherwise provided in these Terms and Conditions, we will not be liable for any claim, loss or expense whatsoever or howsoever arising which is made after the delivery of Products.
We will not, to the fullest extent permitted by law, be subject to any liability which exceeds the replacement value of the Products. We will not be liable for any contingent, consequential or punitive damages arising in any way whatsoever. You acknowledge this express limitation of liability and agree to limit any claim accordingly.
We will not be liable for any claim, loss or expense sustained or incurred by any person arising in any way as a result of the unavailability of Products, any delay in delivery of Products or any failure to deliver Products.
Any advice, recommendation, information or representation provided by us as to the quality or performance of any Products or their suitability for a particular purpose or otherwise in relation to Products is given in good faith but without any liability or responsibility on our part.
General
None of our agents, employees or representatives will have any authority whatsoever to bind us to any affirmation, representation, warranty or condition concerning Products sold under these Terms and Conditions unless such affirmation, representation, warranty or condition is specifically included in writing within these Terms and Conditions.
You agree that all contracts made with us will be deemed to be made in the State of Victoria, Australia and you agree to submit to the jurisdiction of appropriate court in that State.
The provisions of these Terms and Conditions will be separate and severable from each other to the extent that if any provision or provisions are considered to be inoperative then the remaining provision or provisions will be binding on and enforceable by the parties.
In these Terms and Conditions, unless the context otherwise requires:
- "you" means and includes any person accessing or browsing our site and/or completing the registration or shopping process and includes your servant, agent, partner, contractor or employee;
- "Products" means all goods the subject matter of any contract for purchase between you and us;
- a reference to "includes" or "including" means "including without limitation";
- any agreement, warranty, representation or obligation which binds or benefits 2 or more persons, binds or benefits those persons jointly and severally.
